Tom Tardy is a Director in the Jackson, Mississippi office. For over 35 years, Tom has successfully litigated numerous mass tort claims nationally, regionally, and locally on behalf of dozens of defendants, including manufacturers and suppliers of products and equipment, such as brakes, pumps, compressors, boilers, electrical equipment, and others. He serves as national coordinating counsel for three companies' asbestos and silica litigation portfolios, and manages the defense of over 100,000 toxic tort claims nationwide. He previously served as national counsel for a high-target defendant involved in hearing loss and hand arm vibration syndrome litigation. Tom served as counsel of record for a number of defendants in MDL 875, and obtained several notable victories, including landmark decisions on the "bare metal defense". Tom also served as lead counsel in multiple matters before the Mississippi Supreme Court and obtained favorable defense decisions that led to substantive tort reform. He has been certified as a Civil Trial Specialist by the National Board of Trial Advocacy, and for more than 20 years, Tom has been a prolific author and speaker on toxic tort litigation. Tom received an AV® Preeminent Rating by Martindale-Hubbell®. He is recognized by Chambers USA® as a leading individual and by Benchmark Litigation® as a Litigation Star. Since 2008, he has been listed in Best Lawyers in America® and Super Lawyer®. He is also listed in Mid-South Super Lawyers® and as a Top 50 Mississippi Super Lawyers®.

PUBLISHED DECISIONS

Harold's Auto Parts, Inc. v. Mangialardi, 889 So. 2d 493 (Miss. 2004) (finding the prevailing practice of mass joinder of asbestos plaintiffs in Mississippi improper, and holding that single-plaintiff actions would be required and asbestos complaints would have to meet fact-specific pleading standards).

Amchem Products, Inc. v. Rogers,912 So. 2d 853 (Miss. 2005) (holding out-of-state asbestos plaintiffs with no viable connection to Mississippi in terms of work sites or claims against a resident defendant must be dismissed – thus paving the way for the dismissal of tens of thousands of plaintiffs from Mississippi court dockets).

Gorman-Rupp Co. v. Hall, 908 So. 2d 749 (Miss. 2005) (making summary judgment a viable option for many asbestos defendants in Mississippi by explicitly adopting the Lohrmann standard and requiring that an asbestos plaintiff come forward with sufficient and concrete evidence of frequency, regularity and proximity of exposure to respirable asbestos).
